So yeah, I need new underwear

So I’m on the computer a few hours ago doing my own thing, writing code, when I hear a loud BANG at the front door. I immediately knew what was about to happen (why I knew is a long story). I bolt over into the bedroom, grab the gun, chamber a round and stood perched at the top of the stairs. Then the second bang, the door flew open and there stood two dudes intent on entering my house. The alarm system went off, Jill (my g/f) was screaming at them at the top of her lungs. From my standpoint, I only saw from about the waist down so I didn’t have a very good description of the intruders. They never actually came into the house. Jill must have had some killer look on her face because they paused, and turned and ran.

Anyway, there’s another pre-cursor to this story, but I am chosing not to talk about it. Bottom line was nobody got hurt or killed, and my front door is a mess. It seemed random, but you can never be so sure these days. For all I know these guys had been casing this place for a while and just picked a really bad time to drop by for a visit.

Been Quiet Here on the Personal Front

So I haven’t posted in a while. I have a good reason though. Since aroung Thanksgiving time, I’ve been sinking a lot of time into a company I started, Venom Game Labs, LLC. It is basically a company who’s entire goal is to take all the mod makers and indie developers that I can find who are willing to work for free (temporarily) to create a marketable project and sell it. Its pretty cool, I suggest you check it out.

A second note, that actually just caught my attention was the fact that Eric Smith (one of the former programmers, and original creators of the Firearms Half-Life mod) created a website http://www.firearmsgame.com. It is a simple, short, and sweet website that basically sums up all of the rumors flying around about the Firearms: Source versus Firearms 2 fiasco. On that site, he talks about siding with FA2 because they “rescued” the mod. Now, my opinion is that he is correct. The FA2 team, which I was a member of for quite some time, did indeed rescue Firearms. The reason I say this is because I know first-hand, as do many others, what the original Firearms team (myself included) intended to do with the mod after the release of Half-Life 2. The intention was to leave it alone, for good, let it die. I wasn’t happy about doing this, but at the time I no longer had the time to keep plugging away at it. So I also had to let it fall by the way-side. Then a few years later, I had found out that a new Firearms mod was starting for the Source Engine–Firearms 2. Naturally I wanted in on it, I loved working on the first version. So I joined up and started working for a while, then got busy with real-life slapping me in the face and had to go on hiatus for a while.

Once I returned to working on FA2 I found out that Firearms: Source had started up and had been spreading a lot of nasty rumors about how the entire Firearms 2 team are a bunch of theives, etc. Which to me, was a complete lie. Nobody stole anything. We simply went through slightly drastic measures to revive the interest in the game. Keep in mind, this happened well before Firearms: Source even existed. So now this mod, coming out of nowhere, claims they’re the “official sequel” to Firearms because the original creators condoned it. Well, last I checked, the “original” creators left it to die and now just want a peice of the pie once they’ve discovered Firearms 2’s existence. In fact, the REAL creator of Firearms was Eric Smith, and it is his words of approval that are reassuring to us over at the Firearms 2 team.

Now, here’s the kicker, and this has nothing to do with Eric’s talent as a programmer, and his status as the original creator of Firearms. My problem with his statements is that he’s claiming to OWN the “intellectual property” of Firearms. He also claims he can prove this–he has “documentation” supporting this claim. Now, yes its widely accepted that he’s the creator, but when he tries to play the “ip infringement card” on people who want to take the game public and market it, it appears as if he is simply trying to ride the coat-tails of the Firearms name. When he infact, did NOTHING to the new contributions of the game. He has been asked by various members of the community to provide these documents, but they are never produced.

I have a problem with that. If you’re going to make such a bold statement such as “I OWN <xyz> intellectual property” then you better be able to back it up and not simply threaten law suit on someone who supposedly “infringes” upon it. So, I challenge you, Eric Smith, to prove this to everyone. Prove that you actually OWN the Firearms property, and show me the laws that state that Firearms 2, or even Firearms: Source, cannot continue without your consent. I’ve looked for trademarks and copyrights in the US patent and copyright office for anything containing your name. Do you know what I’ve found? Nothing. Yes, nothing. So where is your documentation? Why don’t you just send it over to me in an email. When you send it, I’ll provide it to the nay-sayers and you can indeed claim your place as the “owner of Firearms”.

So I’m Thinking of Starting a Business

Ok, I’m not a business guy, but I have ideas and I want to make a business out of them. I can’t decide if I want to just do business as my own name, or begin making a name formyself by filing for a formal DBA (Does Business As). Or maybe I’ll go for broke and file for an LLC.

As I understand it, an LLC creates a legal entity in name of the business and could be subject to certain fees and licenses, etc. However it has its advantages because then if I ever do something really stupid and lose a bunch of money, or if someone sues me, it will be against the business’ assets, not my own. A DBA doesn’t offer that kind of protection.

Now… herein lies the delima: In the software business, there’s all sorts of bullshit about copyright infringement. I’ve seen it happen to a few business owners that I know first hand. If someone sued me over copyright infringement, I could lose, and I could owe a lot of money out of my own pocket. However, if that same scenario happened to me but I was under an LLC, I could owe everything that my business is worth…. NOTHING. Which is a lot better than paying buku bucks to some dude I pissed off.

I’m not sure what to do. Am I even ready to start a business? Its been on my mind for some time now, but I can’t make myself go through with it unless I’m absolutely ready. The stuff I want to do requires some serious startup capital, which I can’t raise myself. If I have to get investors involved, I’m going to want an LLC and not a DBA for the reason of protection. But if I start it small, using my own funds, I can just build the business as a DBA, then roll it into an LLC if I need to work up some major venture capital or something.

I’m still not sure what kind of paperwork DBA’s have to file in the way of taxes and stuff. Luckily, my girlfriend just got her BS in Business Management. Maybe I can make her my first employee, haha, and let her run the businessy-paperwork stuff.

The Law of Supply and Demand

Any of you living in larger cities in the southern United States may be feeling this as well: Extremely high gas prices and a major shortage of gas!!!!!!!!!!!!!!

It seems that every time a hurricane hits the south-central US, people panic, gas prices skyrocket, and thus there is a self-induced gas shortage in large metro areas. A few weeks back, gas prices were in the $5.00/gal. range in some places; followed promptly by a complete outage of gas supply. Granted the prices have come back down (still not quite near normal), there is still a fundamental problem: gas shortage.

My girlfriend and I drove around for an HOUR last night looking for gas stations that still had ANY gas left. We drove around in a 10 mile radius near our house only to discover one single gas station had gas, and it was about to run out. I lost count of how many gas stations we passed which had their signs taken down, bags on the pumps, and nobody in the parking lots–lights on, nobody home. This particular gas station we stopped at had gone through 3,000 gallons of gas in 2 hours. Bare in mind this is at around 2:00am, thats practically a mid-day rush twice over at 2:00 in the morning. It is 10 times worse during the day time.

Ok, enough about the problem description, how about the cause? If you recall in my above paragraph I stated “self-induced gas shortage”. The reason I say self-induced is because I’ve lived here long enough to notice a pattern, and certain officials agree, that the gas shortage is caused in part, and probably mostly, by a run on the pumps. It is the simple law of supply and demand. If the demand goes up but supply stays the same, prices go up to protect the remaining supply. Stop topping off tanks and filling up gas jugs when you don’t need it. Stop doing it and the problem will go away!

I Finally Got a Fsckin’ Wii!!!

All Linux command-line jokes aside, I did indeed get a Wii…. finally!

Well, about a week ago I walked into a GameStop in the mall since my girlfriend decided she was going to head over to Forever 21… needless to say I didn’t want go with. I chatted with the manager for bit, asking him if he had any Wii’s in stock. He said “No, check back next week. Here’s our number.” Thats the third time I’ve been in that store looking for a Wii, I was beginning to beleive that they NEVER had Wii’s and used the empty boxes just to piss people off.

Well, following that short conversation, he attempted to sell me a PS3 and an XBox 360. Honestly, I don’t think I’d play them. If I’m going to pay nearly $400 for a PS3, it better at least make me breakfast the following morning. When I asked him if it did, he replied with “No, its a selfish lover.” Ok, I’m kidding about that part. After some conversation about upcoming games and other random stuff, he interjected with “You know what, I think I have a used Wii in the back if you’re interested. I’ll sell it to you for $230.” I said “I’ll buy it right now if its in good condition.”

Long story short, here’s my Wii number: 7122 4915 1735 0996. Success!
